Can I go back to Taiwan for Vacation with only US Passport?

Postby dary410 » 01 Dec 2009, 09:50

Hi all,

I'm taiwan-born, immigrated to US at age 11 with green card, naturalized, with overseas chinese stamp on my tw passport.
If I were to go back to Taiwan this winter, can I just use my US passport to enter and exit without any trouble? (only for a ten-day vacation)
I have been back to Taiwan before with just my US passport. But it's been a while, just want to check if any rules have changed.

Thanks a lot,

Dary

I was curious to know when was the last time you did this? I was planning to do the same thing until this came out in Late May of 2010. Basically says that even if you travel to TWN using a foreign passport, you can still be drafted, if you are a dual citizen. Question is how will they know, and what is in the TWN system....

They know who you are, even if you enter with your US passport, rest assured. And chances tho slim they could if they wanted to stop you from leaving and draft you. That be the truth. Why dont you postpone your trip till you are past the age?

I am in the same boat, except It will be 6 more years until I turn 36.
I don't want to wait that long before I visit Taiwan.
It's been 15 years, since the last time I was there.

no one has the right answer for conscription.
local TECO said, since we exited Taiwan before age 16, we can use our US passport that we will be fine.

The law said otherwise.

the closest thing I can find is:
1. renew ROC passport with "oversea chinese" status stamp
2. Exist US with US passport and enter Taiwan with ROC passport with oversea chinese status
3. apply for an Exit Permit of Overseas Chinese Draft Age Men in Taipei before returning to the US, or online here: https://nas.immigration.gov.tw/nasf/ctl ... pplication
4. once approved, exit Taiwan with ROC passport, and enter US with US passport.

but when I do the online application, since I left taiwan at the age of 14, no previous exit permit were found to match against.
so yeah....

I have no idea what the rules are.. and what to do.

the only thing to do is to visit with US passport and take your chances.
although two of my friends have gotten detained using their US passport, and served a 12 months conscription before they can return back to the US.

seems like is not happening anymore...

I have relatives who have deliberately held off visiting Taiwan until they have gotten their full Australian citizenship, then returned on their Australian passport. They have not had any problems.

I would imagine as long as you have never registered your english name on any official Taiwanese documents, the only way Taiwan would know who you are, is if the US notified Taiwan of your english name when you received your US passport? Not sure if they do this?

Not saying they would do this but the other way they could do it is if your place of residence on your entrance card to Taiwan is part of your relatives household registration?

Did these two friends of yours know how to speak Chinese? If not, how did they manage to "serve" a 12 month conscription?
I'd imagine, being functionally illiterate as far as their superiors and fellow draftees are concerned, they'd be more of a liability than an asset...
