I imagine this is very limited and only applies if both parties in a dispute agree to it.The same applies to Islamic banking. Many countries offer Islamic banking. Banking based on religion. What a joke..
Why is it a joke? I was just listening to a BBC podcast on he credit card and it talked a bit about this. The problem is that Islam prohibits usery, which makes it hard for banks to operate. Yet surely Islamic countries need banks and other modernizing institutions. So you can laugh or you can recognize that this is a healthy sign of progress and modernity and one which will surely lead to more progress and more modernity.
The problem I have with the British system is simple. Every citizen should have exactly the same legal rights and protection. Regardless of religion. There is evidence that these tribunals are discriminatory to woman. Woman and woman witnesses are discriminated against under Sharia law. This is a fact.
You are right that both parties need to agree. However this is not relevant to the point I have been making.
Under this system there is no,
Legal advice or support.
Recorded proceedings.
Searchable judgements.
Process to monitor the system.
Right of appeal.
Control of appointment of mediating judges.
Judgments have also been issued that are not congruent with UK or European law.
This is however, secondary to my belief that all should be equal under the law. This is clearly not the case. These Sharia judgments are legally binding and enforceable by county and high courts.
Economics and religion go together like oil and water. Banking should be based on sound economic principles for the interest of all involved. This is clearly not the case with Islamic banking at all. Leave religion in the temple/mosque/church etc.
If Muslims/Jews/Moonies/Hindu's etc want to go live in the UK or anywhere else, it is there responsibility to integrate into the countries laws and customs, and not the other way around.
The bigger problem is political correctness has been taken to far, especially with Islam.
Say anything against it and you are usually labeled an Islamaphobe/racist/right wing/bigot etc etc.
Look at some of the anti semetic cartoons in most Islamic newspapers. I do not see Jews rioting, burning and murdering when this occurs. When a cartoon of that paedophile mohammed appeared there were death threats, riots, burning, murdering, fatwahs being issued etc.
Even more pathetic is that the Western media backed down out of fear. IMO, this was a clear signal to the more extreme types of Muslims that their tactics work and should continue.
